Delaware Rapid Arbitration Act Proceedings
Delaware ADR’s specialized arbitration offerings include proceedings under the Delaware Rapid Arbitration Act (DRAA), providing sophisticated commercial parties with a streamlined and confidential arbitration process for business disputes.
Summary Statutory Proceedings
For summary proceedings under statutes such as the Delaware General Corporation Law, Delaware ADR offers a private alternative to court battles through specialized arbitration proceedings. Corporate disputes such as contested books and records demands, advancement claims, and Section 225 actions are decided on an expedited, summary basis by an experienced decisionmaker while affording parties greater confidentiality and control over the process than public litigation.
Court-Appointed Neutrals
Delaware ADR’s Professional Neutrals serve as judicial adjuncts in various roles as court-appointed neutrals, including in Delaware’s Court of Chancery and the Complex Commercial Litigation Division (CCLD) of Delaware’s Superior Court.
Mediations
Multi-party disputes | Pre-litigation posture and active litigation | Intensive engagement and access with Professional Neutrals | High degree of success
Mediation offers an opportunity for rational exploration of possible solutions and reconciliation of differing interests. Mediation can expand parties’ options for creative resolutions beyond the limited range of outcomes typically available in contested litigation. Delaware ADR’s Professional Neutrals are uniquely qualified to foster principled negotiation, identify parties’ business goals and options for mutual gain, and guide parties to craft durable agreements to resolve disputes. Co-mediation is available for matters that involve especially complex issues, numerous parties, and/or disputed insurance coverage.
Arbitrations
Delaware ADR administration | Flexible options | Highly expedited awards
Arbitration services are available for rulings on the merits of legal disputes. The Professional Neutrals of Delaware ADR offer well-reasoned, evidence-based decisions consistent with principles and legal precedent. Delaware ADR has well-established administrative processes and experienced case management staff, offering efficient and effective management of arbitration matters. We conduct both full and limited arbitration proceedings, as well as offering options that pair limited arbitration on specific issues with other dispute resolution tools such as mediation to achieve a complete resolution.
Neutral Trial Assessments
Neutral trial assessment offers parties the opportunity to present a streamlined, non-binding mock trial to one of Delaware ADR’s Professional Neutrals and receive a prompt, reasoned decision on the merits, along with ex parte sessions for each party to receive tailored assessments and feedback. With Delaware ADR’s “try”-to-resolve approach, neutral trial assessment can lead to informed negotiation or support follow-up mediation or limited arbitration, breaking through logjams and impasses.
Neutral Subject Matter Experts
Delaware ADR’s Professional Neutrals serve in non-advocacy roles as subject matter experts for litigation and disputes requiring opinions on Delaware law and other legal issues.
