Court-Appointed Neutrals
Delaware ADR’s Professional Neutrals serve as judicial adjuncts in various roles as court-appointed neutrals, including:
Special Magistrate (formerly Special Master): Performing delegated duties in an active litigation matter as outlined and authorized by the presiding judicial officer, such as hearing and deciding specified motions.
Discovery Facilitator: Assisting parties and counsel to shape appropriate discovery requests and responses, and resolving discovery disputes that require intervention despite good faith efforts by the parties to meet and confer.
Limited Purpose Receiver: Assisting a court with enforcement of certain judicial orders, such as ensuring compliance with an order requiring production of corporate books and records.
Neutral Subject Matter Expert: Providing independent expert analysis and opinions to assist a court with reaching legal or factual determinations, without advocating on behalf of any involved party.
Delaware Rapid Arbitration Act (DRAA) Arbitrator: Presiding over arbitration proceedings under the DRAA, per appointment by the Delaware Court of Chancery.
Corporate Custodian, Receiver, or Trustee: Providing expertise, administering assets, and performing other specified tasks per appointment by the Court of Chancery pursuant to the Delaware General Corporation Law.
Settlement Claims Administrator or Settlement Monitor: Administering claims and appropriate disbursement of settlement funds arising from lawsuits or arbitrations, and monitoring compliance with settlement terms where required.
