Court-Appointed Neutrals

Delaware ADR’s Professional Neutrals serve as judicial adjuncts in various roles as court-appointed neutrals, including:  

  • Special Magistrate (formerly Special Master): Performing delegated duties in an active litigation matter as outlined and authorized by the presiding judicial officer, such as hearing and deciding specified motions.

  • Discovery Facilitator:  Assisting parties and counsel to shape appropriate discovery requests and responses, and resolving discovery disputes that require intervention despite good faith efforts by the parties to meet and confer.

  • Limited Purpose Receiver:  Assisting a court with enforcement of certain judicial orders, such as ensuring compliance with an order requiring production of corporate books and records.

  • Neutral Subject Matter Expert:  Providing independent expert analysis and opinions  to assist a court with reaching legal or factual determinations, without advocating on behalf of any involved party.

  • Delaware Rapid Arbitration Act (DRAA) Arbitrator:  Presiding over arbitration proceedings under the DRAA, per appointment by the Delaware Court of Chancery.

  • Corporate Custodian, Receiver, or Trustee:  Providing expertise, administering assets, and performing other specified tasks per appointment by the Court of Chancery pursuant to the Delaware General Corporation Law. 

  • Settlement Claims Administrator or Settlement Monitor:  Administering claims and appropriate disbursement of settlement funds arising from lawsuits or arbitrations, and monitoring compliance with settlement terms where required.
